The information contained in this application should not be used as a substitute for a complete wound assessment by an appropriately qualified and licensed physician or other healthcare providers.  This application has been developed to provide Clinicians with information about skin health products and help them make informed decisions about which products are appropriate for specific wound types. The provider must follow all wound treatment protocols  as well as his or her own knowledge, training, experience, and medical judgment. Always consult instructions for use on product packaging and inserts. All remarks, suggestions, ideas, graphics, or other information communicated to Medline through this application will forever be the property of Medline. This excludes protected health information that is input into the app by the user or linked devices. Any material outside of protected health information that is submitted to Medline will be presumed to be public and Medline will not be required to treat the information as confidential. Medline shall have exclusive ownership of all present and future existing rights in the information, except for protected health information, without compensation to the person sending the information.
 

The Information We Collect
Medline collects various types of information from application and website visitors such as first name, last name, email address, phone number, and links viewed to determine user interest. Medline mobile and web application servers may also collect general data pertaining to every user, including the IP address, the domain name, the length of time spent on the website, and the pages accessed while visiting the website through the app. This information is collected to, among other things, aggregate statistical information, facilitate system administration, allow user account creation, calculate measurement values, and improve the content of the app and linked Medline websites. Medline may also retain the content of the communications that are sent to Medline customer service or sales representatives. This information helps Medline to improve/respond to Visitors’ inquiries regarding the application and/or website.

Medline will collect email addresses used to create accounts on this application but will not use these email addresses for promotional marketing material without the express written consent of the user.
 

Security and Privacy
Medline places the utmost importance on protecting information transmitted via the application and takes privacy and security precautions to protect all such information. Additionally, by using the App and website, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

Medline will take measures to secure and protect all health information by maintaining administrative, technical, and physical safeguards within the app. Providers have ownership and control over the patient’s health information they input into the app. Some health information input into the app, excluding the user login information necessary to maintain app security, will be stored locally on the user’s device. Medline is not liable for any issues or breaches that arise from a provider exposing a patient’s health data.
 

How do we access your data?
We access the data you provide us with which is strictly necessary to make the application function properly. We carefully evaluate and define the purposes of any patient and/or personal data processing before launching a project. We will ensure that the patient and/or personal data we collect are relevant, adequate, and not excessive in relation to the purpose of the processing and its eventual use (e.g. insights, marketing, promotions). This means that only necessary and relevant information for the purpose sought can be collected and processed.
 

How do we store your data?
Currently, our application stores offline patient data until the upload is completed and some configuration data in the device itself, the user, and the patient details are stored in a cloud-hosted database provided by Microsoft. We store only the data that is necessary for our application to function in its entirety. Deleting some of this data will interrupt our application functionality. However, if you do not want us to store your data or have any privacy concerns, you can send us your request to MedlinePrivacyOffice@medline.com. 
 

How do we share your data?
We will never transfer, sell, make copies, or share any of your data stored by the application to third-party services or companies unless strictly necessary to enable the application to function properly. Accordingly, personal data will be disclosed to third parties on a strictly limited 'need to know' basis where there is clear justification for transferring Personal Data - either because the Data Subject has consented to the transferor because disclosure is required to perform a contract to which the Data Subject is a party, or for a legitimate purpose that does not infringe the Data Subject's fundamental rights, including the right to privacy (e.g. sharing in the context of a merger and acquisition operation).
 

User Access and Use of Information
Access to this application is limited to viewing the app pages and linked web pages solely for legitimate user and business purposes to access the information provided by Medline at this app and website. Any access or attempt to access other areas of the Medline computer system or other information contained on the system for any purposes is strictly prohibited. You may not use any information contained on this application other than in connection with a legitimate business purpose. Medline has implemented and will maintain administrative, physical, and technical safeguards to protect User and Patient Data.
 

Updates to Terms
Medline reserves the right to modify or amend its Terms of Use at any time, and from time to time. Any changes to the Terms of Use will be posted and can be accessed through the application within the User profile.
 

Foreign Corrupt Practices Act
You acknowledge that you are not the agent of Medline and you represent and warrant that you have not and covenant that you will not pay anything of value to any government employee in connection with the resale of the products.
 

Governing Law; Limitations
These Terms of Use shall be construed, interpreted, and performed exclusively according to the, excluding conflict of law rules, of the State of Illinois, United States of America.  Any legal action concerning any transaction must be commenced within one year after the cause of action has arisen. The provisions of the Uniform Commercial Code as adopted by the State of Illinois, and not the United Nations Convention on Contracts for the International Sale of Goods, shall apply.
 

Dispute Resolution
All disputes between you and Medline of whatever kind shall be finally settled by arbitration in Chicago, Illinois, USA, under the Rules of the American Arbitration Association, which Rules with respect to matters not regulated by them shall incorporate the UNCITRAL arbitration rules by one or more arbitrators appointed in accordance with said Rules applying these Terms of Use and consistent provisions of the internal laws (except the conflict of law rules) of the State of Illinois, USA.
